2026 VENDOR APPLICATION & AGREEMENT

IMPORTANT INFORMATION: Please read carefully!

• The Farmers Market will run from 5-7:30pm every Thursday starting June 11^th-Sept. 24th.

• You will be assigned a 10’x10’ vendor space on 3rd Street.

• Vendors may arrive at 4:00 pm to set up and must remain set up until at least 7:30pm.

• There will be NO parking on 3rd Street, once you have set up, you must park your car along Pine or Sullivan Street.

• Vendor vehicles must be off 3rd Street by 5pm sharp!

• 3rd Street will be closed to traffic from 3pm-9pm.

• Music in the park runs from 6:00pm until approximately 8/8:30pm.

• Farmers Market Vendors are welcome to stay until the end of the music, but are not required to.

• This is a rain or shine event. If we decide to cancel due to weather, we will send out a mass text & email as well as post on our Facebook and Instagram accounts.

• If you need to cancel your space- Email us at WBoTMarket@gmail.com as soon as possible. (Missing 2 scheduled markets is grounds for dismissal from the market).

• WBoT gives the right to accept or deny vendors.

• All FOOD VENDORS must comply with NYS Department of Health Regulations.

• Tent, Tables, Chairs or Electricity are NOT provided. Generators are not allowed at the market.

• Porta-Potty will be available.

• All vendors must carry at least a one million dollar in public liability coverage that covers the Wurtsboro Board of Trade and the Village of Wurtsboro named as additional insureds. A copy of your Certificate of Insurance will be required to gain acceptance into the market.

• All forms must be submitted via email or mail by May1st, 2026. Wurtsboro Board of Trade, P.O. Box 907, Wurtsboro, NY 12790 or WBoTMarket@gmail.com .

• All completed forms must include:

~ Vendor Application Completely Filled Out & Signed

~ Copy of Certificate of Insurance as mentioned above.

~ Copy of Sales Tax Certificate (If applicable)

~ Department of Health Certificate (If applicable)

~ Any other permits, licenses or certificates that are required

***Once we receive, review and approve your application we will email you with approval and amount owed. Payment for each Market must be paid at time application is approved. An email with a link to make the payment will be sent to you. Application will be accepted on a "First come – First serve” basis. “Week of” sign-ups are allowed if space allows.

Cancellation Policy:

1. In the event the WBoT calls for cancellation of the market for any reason (weather, staffing, etc.) reimbursement will be of cost of Market dependent on payment.

2. Any vendor cancellation forfeits fee.

3. Two or more vendor “no call, no show” in a given market season is subject to removal from any remaining 2026 Market dates.

Failure to arrive at the event without reason will result in the WBoT’s assessment of your future prospect of being a vendor.

~All signage and displays must remain within your assigned vendor space.

~Vendors are responsible to clean up their spots at the end of each market.

~Vendor signage must be displayed clearly with name and pricing.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

Release of Liability and Indemnity

I hereby release and forever discharge the Village of Wurtsboro, the Town of Mamakating and the Wurtsboro Board of Trade, its employees, and any of said entities employees, officers, agents, volunteers, members, and any other person for whom each party may be held responsible (collectively, the “Organizers”), from any and all liability for any injury (including death) and any property damage, or damage of any other kind, that I may sustain as a result of my participation in the Music & Farmers Market. I hereby also agree to indemnify and hold the Organizers harmless on account of any claim by any other person, whether caused by negligence, breach of contract, or breach of any statutory or any other duty of care.

Waiver

I hereby waive any right I might have to make any demand or claim, or to commence any action or lawsuit against the “Organizers”, for any injury (including death), and/or any property damage or damage of any other kind, that I could sustain arising out of or in relation to my participation in the Music & Farmers Market activities. I further waive any right I might have to make any demand or claim, or to commence any action or lawsuit against any other person or corporation who might, in turn, make a demand or claim, or commence an action or a lawsuit against the “Organizers”.

Permits & Licenses; Requirements with Law 

I hereby agree that I shall at my own expense timely obtain and shall maintain all governmental approvals, permits, authorizations, and licenses to permit me to participate and offer and sell my crafts at the Music & Farmers Market in accordance with the requirements of law including, but not limited to, New York State tax numbers and authorizations, and/or New York State Gaming Commission licensing (if applicable). Proof that I have obtained all such permits and authorizations shall be promptly delivered to Wurtsboro Board of Trade and I shall be solely responsible for the timely collection and reporting and payment of all New York State sales taxes.  None of the “Organizers” shall have any responsibility or liability for my failure to comply with the provisions of this paragraph. I shall prominently display my tax identification number at my designated location at the Music & Farmers Market at all times, and prior to Music & Farmers Market provide Wurtsboro Board of Trade with a current and accurate copy.  In addition to the foregoing, I agree to fully and timely comply with all applicable laws, rules and regulations relating to my work or participation at the Music & Farmers Market.

By signing below, I agree to participate to the Music & Farmers Market and I acknowledge my understanding that neither the Wurtsboro Board of Trade nor the Village of Wurtsboro provides any liability coverage for my business, merchandise or its employees.     

I declare that I have read and understood this document in its entirety and consent to the foregoing.  This document shall be binding upon me and my heirs, legal representatives and assigns.
